These General Terms of Use govern the contractual relationship between Worden and any User of the Website or holder of a Worden boutique loyalty card.

MONTAZ Distribution undertakes to comply with the applicable regulations in force regarding the processing of personal data and, in particular, Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016, applicable from 25 May 2018 (hereinafter referred to as the “European General Data Protection Regulation”).
Users are invited to read this document very carefully and to review it each time they visit the Website.

Use of the Website constitutes acceptance of these General Terms of Use.

All data entered by users on the Website and in MONTAZ Distribution group stores remain private and are not sold or rented to third parties.

MONTAZ Distribution processes only the personal data of its customers. The data collected are also used for anonymous website traffic statistics. These data correspond to information provided when placing orders or submitting contact requests.

With the customer’s explicit consent, these data may be used for promotional or commercial purposes exclusively within the MONTAZ Distribution group.

Customers have the right to access, delete, and rectify their personal data. These data are stored for a maximum period of 10 years following the last order. Deletion of an online account results in the anonymization of any past orders. However, named invoices remain accessible to tax authorities.

Traffic data and cookies are stored on your computer for internal, non-personal analysis of visits to the Website’s information pages, in order to improve content and generate statistical data (pages viewed, consultation times, etc.).

ARTICLE 1: PRICES

1.1 Product prices are indicated in euros, all taxes included, excluding processing and shipping costs (see Article 3).

1.2 For orders shipped to a country other than mainland France, you are considered the importer of the product(s). For all products shipped outside the European Union, prices will automatically be calculated excluding taxes on the invoice. Customs duties or other local taxes, import duties, or government taxes may be payable. These charges are not the responsibility of WORDEN and are entirely borne by the customer, both in terms of declaration and payment to the relevant authorities. We recommend that you inquire with your local authorities.

1.3 All orders, regardless of their country of origin, are payable in euros.

1.4 WORDEN reserves the right to modify its prices at any time. Products will be invoiced based on the rates in force at the time the order is registered, subject to availability. In the event of a technical error resulting in an incorrect price (for example, a pair of skis priced at €20), Worden will immediately inform the customer and correct the error, but will not be obliged to supply the product at that price.

1.5 Products remain the property of WORDEN until full payment has been received.

ARTICLE 2: AVAILABILITY

Product offers are subject to stock availability in stores or at our suppliers.
Displayed stock levels are updated every 10 minutes; therefore, an item may become unavailable between updates.

In the event of unavailability, you will be informed by email or telephone as soon as possible. If the unavailable product was part of a paid order, it will be refunded by check or the credit card transaction will be canceled. For products not immediately available, we will inform you and ask for your instructions (refund or replacement product).

ARTICLE 3: DELIVERY

3.1 Products are delivered to the delivery address provided during the ordering process. Delivery times are average estimates and include order processing and shipping time.

3.2 If items are deliverable on different dates due to availability, delivery time will be based on the longest lead time. Worden reserves the right to split deliveries; in such cases, shipping costs will be charged only once.

3.3 Processing and transport times vary. Shipping costs will be indicated during order validation. An express delivery via Chronopost within 24 hours is available upon request. For next-day delivery, the order must be validated before 1:00 PM. Express shipping costs are entirely borne by the customer.

ARTICLE 4: PAYMENT

4.1 Credit card: Visa, Mastercard

4.2 Payment in 3 or 4 installments by credit card for purchases from €150 to €3,000 with Oney.
Our partner Oney Bank allows payment in 3 or 4 installments.

Conditions:
This offer is reserved for private individuals (adults) residing in France and holding a Visa or Mastercard with a validity date exceeding the chosen financing period. Cards with systematic authorization (Electron, Maestro, Nickel, etc.), e-cards, Indigo cards, and American Express are not accepted.

Subscription process:
After completing your order, click on the “pay in 3 or 4 installments by credit card” button. You will be redirected to the Oney website showing a detailed order summary and personalized financing request. You must enter your personal information or log in using your Oney account credentials. You will be provided with the general terms of installment payment in PDF format for review, printing, and saving before acceptance. Acceptance is confirmed electronically via a checkbox. The double-click associated with this checkbox constitutes irrevocable acceptance of the financing terms.
Unless proven otherwise, data recorded by Oney Bank constitute proof of all transactions. Information related to your order will be transmitted to Oney Bank for credit assessment, management, and collection purposes. Oney Bank reserves the right to accept or refuse financing requests. You have a 14-day withdrawal period.

Operation:
Payment in 3 or 4 installments includes:

• A mandatory initial payment charged upon shipment confirmation, equal to one-third or one-quarter of the order amount, plus fees of 1.62% for 3 installments or 2.43% for 4 installments (maximum €10 for 3 installments and €20 for 4 installments);

• Two or three monthly payments charged at 30 and 60 days (3 installments) or 30, 60, and 90 days (4 installments).

4.3 PayPal
Payment via PayPal account or PayPal interface using a credit card (Visa, Mastercard, American Express, etc.).

4.4 Bank transfer
Once your order is validated by bank transfer, the product is reserved and removed from stock. The order is shipped upon receipt of payment (approximately 2–3 days). Orders are automatically canceled if payment is not received within 7 days.

4.5 Gift voucher
Usable on the website: select “gift voucher” as the delivery method and send it by mail, with an additional check if necessary.

4.6 Apple Pay
Pay securely and quickly using Apple Pay on your Apple smartphone.

ARTICLE 5: RIGHT OF WITHDRAWAL

If you change your mind and the product has not been used, you have 30 business days to return it.
Log in to “My account” and access the order containing the product to request a return for size exchange or refund.

Customized products, such as drilled and mounted skis adjusted to your size, are non-refundable.

For defective products, we generally require a photo and a detailed description of the issue by email.

If our responsibility is involved, we will provide a return label so you do not have to pay return shipping costs.

Please include an explanation of the return along with your name and address inside the package, and attach proof of purchase for warranty claims.

ARTICLE 6: SECURITY

Our website uses a security system: 3D Secure.
We use secure payment methods and encryption for transmitted information.

ARTICLE 7: LIABILITY

Products comply with current French legislation. MONTAZ Distribution cannot be held liable for non-compliance with the legislation of the destination country. It is the customer’s responsibility to verify import and usage regulations with local authorities.

ARTICLE 8: APPLICABLE LAW

In the event of a dispute, French courts shall have exclusive jurisdiction.

ARTICLE 9: MEDIATION

In accordance with the French Consumer Code, MONTAZ adheres to the e-commerce mediation service of the CM2C (Centre for Consumer Mediation of Justice Conciliators).

Orders are processed within a maximum of 48 hours. Express orders must be received before 1:00 PM.

ARTICLE 11: LEGAL GUARANTEE OF CONFORMITY

All products sold on Montaz.com are subject to the legal guarantee of conformity under Articles L211-4 to L221-14 of the French Consumer Code and the warranty against hidden defects under Articles 1641 to 1648 and 2232 of the French Civil Code.

Products are supplied by well-known brands recognized for quality and craftsmanship. The guarantee applies under normal use as intended by the manufacturer.

Claims for apparent non-conformity or visible defects must be made within 3 days of receipt by email or registered letter with acknowledgment of receipt to:

Return shipping under warranty is covered by MONTAZ Distribution SARL. Damage caused by insufficient packaging is not the responsibility of MONTAZ Distribution SARL. Return shipping to customers after after-sales service is covered by MONTAZ Distribution SARL.

If a returned product is not covered by the conformity guarantee, it will be returned to the customer with shipping charges due. Damage caused by impacts or manufacturer-specific exclusions is not covered.

MONTAZ Distribution SAS cannot be held liable for improper or intensive use of products. Products not sold on our websites do not fall under our responsibility.
